RTI Odisha: Procedure to file RTI Application

Under sub-section (1) of section (6) of the RTI Act, you can submit request for information or inspection of record before concerned Public Information Officer. You can file RTI Application in Odisha both Online and Offline. You may follow the following steps to submit request for information offline:

Step – 1: Identify the department to which your information most closely belongs.

Step – 2: Find the address of the Assistant Public Information Officer/ Public Information Officer of the concerned department.

Step – 3: Write your RTI Application on a plain paper in the format provided below. You can write your RTI application in either Oriya or English language and will get the reply in Oriya or English.

Step – 4: Pay the Fees of Rs. 10/- per application by way of Treasury Challan/ Cash.

Step – 5: Attach the following documents along with the application:

1) Identity Proof (Copy)

2) Proof of Fees Payment

2) Any documents, which you may have referred in the application.

Step – 6: Submit the completed RTI Application to the Assistant Public Information Officer/ Public Information Officer either personally or through Speed Post/ Registered Post.

Note:

1) If you are sending your application by post, you should send it by speed/registered post so that you have proof of postage. If you are submitting your application in person, always make sure to ask for the acknowledgement for receipt of the application. The acknowledgement may have following details:

2) If you receive the Information from PIO to make Payment for information, you shall deposit the said amount within a period of fifteen days from the date of receipt of such information, failing which the application shall stand rejected.

RTI Odisha: First Appeal under RTI

Under sub-section (1) of section (19) of the RTI Act, any person who, does not receive a decision within the time specified in sub-section (1) or clause (a) of sub-section (3) of section 7, or is aggrieved by an order of the Public Information Officer may, within thirty days from the date of receipt of the order of the Public  Information Officer, prefer an appeal to the concerned appellate authority.

(1) An appeal fee of Rs. 20/- by way of Court Fee Stamp; and

(2) A copy of such order appealed against (Reply of State Public Information Officer, if any).

Step – 4: Submit the completed RTI First Appeal to the First Appellate Authority either personally or through Registered Post.

RTI Odisha: Second Appeal under RTI

Under sub-section (3) of section (19) of the RTI Act, any person aggrieved by an order of the appellate authority under sub-section (1) of section 19 may, within ninety days from the date of receipt of the order of the appellate authority, prefer a second appeal to the Odisha Information Commission.

(2) Self-attested copies of the orders or documents against which the appeal is preferred;

(4) An index of the documents referred to in the appeal; and

(5) Self-addressed duly stamped envelop for intimation of defects in case the memorandum of appeal is sent by registered post.

Step – 1: Write your RTI Complaint on a plain paper. You can write your RTI Complaint in either Oriya or English language and will get the reply in Oriya or English. Your complaint shall include following details:

1) the name and address of the complainant;

(2) the name and address of the officer or officers against whom complaint is made;

(3) the facts relating to complaint and when and where it arose;

(4) document, if any, as are necessary to prove the allegation made in the complaint petition and

(5) the relief sought for.

Step – 2: You may attach the following documents along with your RTI Complaint:

(1) Self-attested copies of the orders or documents against which the complaint is being lodged;

(2) Copies of documents relied upon by the appellant and referred to in the complaint;

(3) An index of the documents referred to in the complaint; and

(4) Self-addressed duly stamped envelop for intimation of defects in case the memorandum of complaint is sent by registered post.
