RTI Rajasthan: Application/ Appeal/ Complaint Procedure, Fees RulesIn exercise of the powers conferred by section 27 of the RTI Act, 2005, the Rajasthan Government passed the Rajasthan Right to Information Rules, 2005, which provides the details of fees for application, and information, and procedure for appeals. In this article, I have summarized the RTI Rajasthan: Application/ Appeal/ Complaint Procedure, Fees Rules for your quick reference.

RTI Rajasthan: Procedure to file RTI Application

Under sub-section (1) of section (6) of the RTI Act, you can submit request for information or inspection of record before concerned Public Information Officer. You can file RTI Application in Rajasthan both Online and Offline. You may follow the following steps to submit request for information offline:

Step – 1: Find the department to which your information most closely belongs.

Step – 2: Find the address of the Assistant Public Information Officer/ Public Information Officer of the concerned department. You may use Find PIO or PIO Details to know the details of PIO.

Step – 3: Write your RTI Application on a plain paper or through electronic means in English or Hindi or Rajasthani in the format provided below. This format is not mandatory. You may use your own format. The application should, however, have the name and complete postal address of the applicant.

Step – 4: Pay the Fees of Rs. 10/- per application by way of Postal Order or Cash against proper receipt or by Demand Draft or Bankers Cheque payable to the public authority.

Step – 5: Attach the following documents along with the application:

1) Identity Proof (Copy) (Not mandatory, but recommended)

2) Proof of Fees Payment

2) Any documents, which you may have referred in the application.

Step – 6: Submit the completed RTI Application to the Assistant Public Information Officer/ Public Information Officer either personally or through Speed Post/ Registered Post.

Note: If you are sending your application by post, you must send it by registered/speed post so that you have proof of postage. If you are submitting your application in person, always make sure to ask for the acknowledgment for receipt of the application.

RTI Rajasthan: RTI Fees Rules: RTI Fees Structure:

There shall be NO Fees in case of a person whose name appears in the latest list of persons Below Poverty Line for which he has to produce BPL Card. Otherwise, fees shall be charged as per the following details:

RTI Rajasthan: First Appeal under RTI

Under sub-section (1) of section (19) of the RTI Act, any person who, does not receive a decision within the time specified in sub-section (1) or clause (a) of sub-section (3) of section 7, or is aggrieved by an order of the PIO may, within 30 days from the date of receipt of the order of the PIO, prefer an appeal to the concerned appellate authority.

You can file RTI First Appeal in Rajasthan both Online and Offline. You may follow the following steps to submit First Appeal offline:

Step – 1: Find the address of the First Appellate Authority (FAA) of the concerned department. If you have received reply from the PIO, then details of FAA may be mentioned in the reply.

Step – 2: Write your RTI First Appeal on a plain paper or through electronic means in English or Hindi or Rajasthani in the format provided below. This format is not mandatory. You may use your own format to write First Appeal.

Step – 3: Attach the following along with your First Appeal:

(1) A copy of such order appealed against (Reply of Public Information Officer, if any).

(2) A copy of any other document upon which you rely.

Step – 4: Submit the completed RTI First Appeal to the First Appellate Authority either personally or through Registered Post.

RTI Online Rajasthan: Procedure to submit RTI First Appeal Online in Rajasthan

RTI Rajasthan: Second Appeal under RTI

Under sub-section (3) of section (19) of the RTI Act, any person aggrieved by an order of the FAA under sub-section (1) of section 19 may, within 90 days from the date of receipt of the order of the FAA, prefer a second appeal to the Rajasthan Information Commission.

You can submit RTI Second Appeal in Rajasthan both Online and Offline. You may follow the following steps to submit Second Appeal offline:

Step – 1: Write your RTI Second Appeal on a plain paper or through electronic means in English or Hindi or Rajasthani in the format provided below. This format is not mandatory. You may write your Second Appeal in your own format. However, your Second Appeal must include below details:

Contents of Second Appeal: You must include following details in your Second Appeal to the Commission:-

(1) name and address of the appellant;

(2) name and address of the State Public Information Officer;

(3) particulars of the order against which the appeal is made including number and date;

(4) brief facts leading to the appeal;

(5) grounds for the prayer or relief;

Step – 2: Documents to accompany Second Appeal: You shall attach the following documents along with your Second Appeal:

(1) attested true copy of the order against which the appeal is being preferred;

(2) copies of documents relied upon by the appellant and referred to in the appeal; and

(3) an index of the documents referred to in the appeal.

RTI Rajasthan: Procedure to submit RTI Complaint in Rajasthan

Under sub-section (1) of section (18) of the RTI Act, you can lodge complaint before Rajasthan Information Commission. You can file RTI Complaint in Rajasthan both Online and Offline. You may follow the following steps to submit RTI Complaint offline:

Step – 1: Write your RTI Complaint on a plain paper or through electronic means in English or Hindi or Rajasthani language. Your complaint may include following details:

(1) the name and address of the complainant;

(2) the name and address of the officer or officers against whom complaint is made;

(3) the facts relating to complaint and when and where it arose;

(4) document, if any, as are necessary to prove the allegation made in the complaint petition and

(5) the relief sought for.

You may refer to the Sample Complaint to know what to write in RTI Complaint under section (18).

Step – 2: You may attach the following documents along with your RTI Complaint:

(1) Self-attested copies of the orders or documents against which the complaint is being lodged;

(2) Copies of documents relied upon by the appellant and referred to in the complaint;

(3) An index of the documents referred to in the complaint; and

(4) Self-addressed duly stamped envelop for intimation of defects in case the memorandum of complaint is sent by registered post.
